Robert Bleakley and Darryl Beckman represented Westfield, LLC and Countryside Mall, LLC in a contractual indemnification against a plumbing contractor and its insurance carrier that refused to indemnify and insure the mall when a pipe upon which the plumbing contractor was working caused personal injury to a mall tenant. Mr. Beckman persuasively argued to the trial court judge the plumbing contractor was contractually responsible for indemnifying the mall and its insurer was required to defend and indemnify the mall from the personal injury claims brought by the mall’s tenant. The firm is seeking to recover all of the mall’s attorneys fees and costs from the subcontractor and its insurer because of the wrongful failure to defend.
